The Speaker of the Perak Legislative Assembly V Sivakumar has suspended the newly sworn in excos including new Menteri Besar Ramly Zahary for 12 months. Is he going according to procedures or acting with malice?
The Speaker has created a crisis situation, a stalemate.Perak has no government.Sivakumar could be made to answer on what disciplinary ground the 6 excos were suspended.The 6 was appointed following the appointment of a new menteri besar and a new government by the Sultan.By procedure Sivakumar should continue to act as Speaker of the house in a new government and should act impartially and with out malice.It should be business as usual and he should act as Speaker for the house and not as speaker for Pakatan. It was clear his action was to dwindle the number of BN assemblymen and to give Pakatan a majority sitting in the house for the next 12 months.
Is it going to happen, will Pakatan be back in the government? Was the speaker acting beyond his powers and his action construed as illegal.
If the impasse continue than Perak is moving toward emergency rule.The Federal government can go to the Agong and ask him to declare emergency in Perak under Article 150 of the Federal constitution.

Which is better than emergency rule.
Just dissolve the state assembly and snap elections, whoever wins can then appoint the Speaker and rule the state.
We all know why Barisan wont do it, dont we, I am just surprised you chose NOT to highlight this option but talk nonsense about Emergency this and that.
I cannot agree more with Anonymous (February 19, 2009 9:58 AM). That option is not considered by the Hantulaut because the BN might just lose again if the state assembly is dissolved, and fresh elections are held. Hantulaut prefers the ridiculous and outdated option of emergency rule, because he is clearly a BN supporter and doesn't want BN to be defeated yet again.

Lets see the grounds for suspension...As far as I read the rules of the House, he's not exceeding his powers and its not illegal, but NOBODY has the right to simply exercise powers without accountability.

You are right I didn't mention dissolution because I don't see it as an option anymore because the Sultan has refused dissolution in the first place.The Speaker has acted with malice, there is no two way about it.The BN will not agree to a dissolution because they have the majority.
What the Speaker should have done was asked for the Assembly to be re-convened and to be attended by all assemblymen to pass a vote of no confidence against the new MB.Pakatan wouldn't dare because they knew they would lose the government.

you are completely off-tangent.
The Sultan did not agree to dissolve the assembly was completely due to a different set of circumstances.
the last time he refused he had a majority of assemblypersons before him.
Now if the state assembly convenes and Barisan is voted down with a motion of no-confidence, how can he refuse to dissolve. You cant equate the 2 as the circumstance is diffreent.
Now, you say the Speaker is acting with malice and illegally. Fine.
But what is good for the goose is also good for the gander. Why? You claim Barisan can invoke Emergency rule because its provided under the constituition, fine. The Speaker is provided with the power to suspend under the Perak state constituition, theres nothing about malice or mala fide.
I can say the same thing, if the PM invokes emergnecy rule, he is also doing it with malice and mala fides much like Sivakumar is doing.
Bottom line is if you say PM has rights under Constituition, Sivakumar has the same rights under Perak State Constuition to suspend the crap out of the illegal MB.

How? You cannot have a member of the opposition declare himself to be the MB and hope to get away with it. Who is being malicious here??

The BN has a majority? Who says? It is clearly a hung state assembly now. Three ADUNs from the Pakatan have resigned, and both the Pakatan and Barisan have equal number of members.

You are twisting your words again! How can the Agong "agree" to emergency rule if BN does not want it?? The Agong does not proclaim emergency rule just because he wants it. Is the Pakatan's action unlawful? The speaker can suspend the members who have definitely acted beyond what they could do within the constitution. All the speaker needs to do now is to convene the State Assembly and debate the matter.
Are things too much for you, HL? Then don't you agree that the best way is for the state assembly to be dissolved, and fresh elections called? If the BN is really all that good, they should be able to get the majority of seats. Why are you worried about this prospect??
