Was I wrong when I predicted the Sultan of Perak would not grant a dissolution of the assembly because there were no justifiable reason to do so. In my post 'Anwar: Don't Cut Off Your Nose To Spite Your Face" I mentioned that the Sultan is not likely to agree to a dissolution. Surprisingly, some lawyers believe the Sultan must give consent to go back to the people for fresh mandate without looking at the situation closely.
What are the 59 assemblymen elected for ? Aren't they representatives and voices of the people ? Why must there be fresh mandate when majority of the people's representatives have decided they have no more confidence in the present government. If the people are not happy with the conducts of their elected representatives they have the opportunity to throw them out at the next elections.You just don't dissolve the assembly every now and then or whenever a few slime balls gone party hopping.
First and foremost, we have to respect the Constitution and not use our emotions to justify what we wanted and ignore what the law wanted.The constitution is very clear and have given the ruler flexibility to decide according to circumstances. The ruler cannot be faulted for any decision made as long as he acted in accordance with the law.The Sultan press release here.
The Sultan of Perak Azlan Shah had acted wisely and in accordance with the constitution.Those who said he had not were ruled by their heart, not their head, they based their argument by emotions because they happened to be Pakatan supporters. There were also lawyers who made wilful interpretation of the law, intentionally to confuse and rile up Pakatan supporters into believing that the Sultan had acted unjustly.
Was there a stalemate, chaos or no clear winner in this unpleasant episode ? There wasn't.None of those situation exists to justify a dissolution.
The Pakatan refusal to respect democracy,the Constitution and the decision of the Sultan is going to have a huge backlash on them.The calling of a mammoth rally of 100,000 strong in an act of defiance and show of force speaks for itself the kind of politicians they have in that grouping.

Sultan Azlan Shah had decided there will be no dissolution of the assembly.Menteri Besar Nizar had been asked to step down to pave way for new MB and state government to be sworn in.
Anwar Ibrahim defiant and plan for a mammoth gathering of 100,000 of Pakatan supporters tonight at Stadium Ipoh.
IGP issued warning for people not to attend.
Anwar is out of his mind. The Sultan has spoken and his decision should be respected.The Sultan has not erred, he decided exactly as what was called for in the constitution and in accordance with the democratic process.

Pakatan is planning a mammoth rally if the Sultan of Perak does not agree to the dissolution of the Perak state assembly ? Anwar Ibrahim and Pakatan may be making a big mistake here if they think the Sultan is going to take lightly to this kind of intimidation of the palace.
It is the process of democracy. No menteri besar and his government can stand if he has lost command of majority confidence of the members of the house.As there are alternative entity that have the confidence of the majority of the members a fresh mandate is not necessary.A fresh mandate is only necessary when there is chaos and no clear alternative that enjoy majority support to be menteri besar and to form a government.Whether Pakatan likes it or not that's what the constitution prescribed.You don't dissolve the whole assembly just because the majority has lost confidence in the menteri besar.
To demonstrate is to show disrespect for the Sultan and surely looking for trouble.Let's hope Anwar uses his good judgement.The PKR and Pakatan people should accept the outcome with decorum.
Sultan Azlan Shah is a good sultan and well-versed with the law. He was a former Lord President and should know his decision would be in accordance with the state and federal constitutions. That's why he can't simply give the dissolution of the assembly to the Menteri Besar when he met him, he has to look at other considerations ,he has to hear what the other side has in store, whether they have the majority support to form the government.
The sultan has the power to appoint anyone as menteri besar whom he thinks has the command of the majority support of the members of the house. That person needs not necessarily must come from the BN. All he needs is the majority support of the members of the house.
Should the Sultan, in his good judgement, thinks no one command the majority support and confidence of the members or there exists a stalemate than he can proceed to dissolve the assembly.
I don't have to quote the relevent section of the Perak state constitution as most of the states have quite similar contents and similar to Article 43 (2) (a) of the Federal Constitution.
No menteri besar, no political party and no demonstration can influence the Sultan's decision, he is guided by the constitution.
The biggest problem with PKR was its choices of elected representatives both states and parliament. It was in such a hurry to fill up nominations for candidates in the March 2008 Elections no filtering and thorough screening of candidates were done and the party is now landed with a motley crew of riff-raff, slime ball and soldiers of fortune. PAS and DAP seem to have less of this kind of problems.

The Moneyed Kind: Is Kedah Next ?

The ephemeral rule of Perak by Pakatan should be a lesson for them not to play with fire. Anwar Ibrahim's arrogance and game of cat and mouse had backfired on him.If you think you can do it we can do better seems to be what Najib must have said to himself quietly.At this juncture there is still no sign of the Sultan agreeing to dissolve the state assembly and it appears he is not likely to.Only 4 assemblymen have shifted out of the government and would probably change allegiance and support the BN to form the new government.Appears no justification to dissolve the whole assembly and spend unnecessary funds on fresh elections.

Now, Anwar Ibrahim can't scream injustice or accused the BN of undemocratic means, it was the game he started and wanted to play to take away BN's MPs to topple them so he could be prime minister.Unfortunately, none took his baits.His September 16 2008 dateline and his claim of 30 frogs crossing over to his side never took place.

After almost a year, with the exception of SAPP leaving the BN, only one cross over from BN to PR took place and for less than two weeks the slime ball has returned back to UMNO and brought with him more PR assemblymen.
The only states in the PR stables that looked safe would be Penang and Kelantan.
Kedah may be the next one to go.The PR has 21 against BN 14, the BN needs only 4 to cross over to take the government.Selangor looked harder, but not impossible, the BN needs 9 to take the government.Once the BN get these few states, surely some MPs from Pakatan may not want to miss the train.
For almost a year Anwar had thrown empty threats at the BN that their days are numbered and many BN MPs have agreed to cross over to join Pakatan.The empty threats had not produced any BN's MP crossing over to his side.
The moral of the story is one must learn never to make threats you cannot carry out.It may come back to haunt you.
