Anwar: Blow by Blow

By Gopal Raj Kumar

ANWAR: CONVENIENTLY FORGOTTEN TRUTHS ABOUT THE MAN AND MYTH
  1. Anwar Ibrahim did nothing to reform the system when he was an insider. And mind you, he was sitting at its apex and even acting as prime minister between May and July 1997.He did nothing towards a repeal of the ISA, OSA, Emergency Ordinance or Sedition Act. Nor did he roll back the restrictions imposed by the Societies Act and the UUCA.
  2. In the 16 years that Anwar was rising up the Umno ranks until he was a heartbeat away from the very pinnacle, he made no changes for the better from the inside. On the contrary, it was he who poisoned Umno’s well through expanding and entrenching the culture of patronage and money politics.
  3. He is no democrat. In 1995, the Umno general assembly decided that the top two posts should not and would not be contested in its 1996 party election.
The assembly instructed that only Dr Mahathir Mohamad and Anwar could be nominated for president and deputy president respectively. Anwar was deep in the bowels of the BN system that has been dubbed a “guided democracy”.
Neither is Pakatan democratic. In the DAP, the first families of Lim and Karpal rule like as if the party is their personal fiefdom.
Guan Eng’s younger sister Hooi Ying is Penang DAP secretary. Three of Karpal’s children – Jagdeep, Gobind and Ramkarpal – are YBs. Ramkarpal was gifted an inheritance of his father’s Bukit Gelugor Parliament seat.
As for the PKR first family, Daddy is Anugerah Tuhan aka ketum parti, Mommy is president and Oldest Girl is vice president. There’s even talk of Younger Girl being given the chance to contest Permatang Pauh, previously rotated between her parents.
What democracy are Pakatan people talking about?!
  1. Anwar was so Machiavellian in the ruthless way he toppled Ghafar Baba. Anwar was confirmed twice as Umno deputy president – in the 1993 and 1996 general assemblies.
He planted cells everywhere, appointing his coterie to vital and pivotal positions in the superstructure of the state. He was like a giant octopus with tentacles spread over the Umno machinery and the entire government bureaucracy. In short, he was a control freak.
Side note:
Man-in-a-hurry Anwar only served as Dr M’s deputy in Umno for five years (1993-1998) before trying to oust his boss. Unlike the treacherous Anwar, Tun Razak was a loyal deputy to Tunku Abdul Rahman. Tun Razak was Umno deputy president for 20 years (1951-1971) until Tunku resigned his party presidency in June 1971.
  1. True, Anwar was infamously given a black eye by the IGP but he was certainly not “beaten to within an inch of his life” as his declared by his lawyer. Reminder:A member of the Bar is not an aspiring novelist (or is he?). Hence he should always endeavour to be more factually precise in his expression and refrain from engaging in hyberbole.
Anwar, on the other hand, is an acknowledged drama queen. If you’ll recall, he had also alleged that he was being poisoned with arsenic. Oh, and the stage props – that ubiquitous neck brace and the wheelchair

If You Don't Know The Law, Don't Talk........

Hantu Laut

If you don't know the law, don't talk!

Obviously, the defence lawyer is talking cock here and Malaysiakini talking bigger cock here.

The whole idea is to mislead Malaysians, the unthinking society.

Malaysians are easily swayed by what they read or hear.

The CJ is right here.

Malaysia is not short of half-past-six lawyers.

Illegally obtained evidence is also called "fruit of the poisoned tree"

What constitutes illegally or improperly obtained evidence?

It is a fundamental principle of English law and a requirement of the European convention of Human Rights that in a criminal trial, the prosecution bears the burden of proving the guilt of the accused. Article 6 European Convention of Human Rights requires a presumption of innocence on the accused. To prove guilt, the prosecution must obtain evidence to support their position. The prosecution may resort to improper means to gather evidence in support of their position especially if obtaining evidence in conventional ways proves unfruitful.

Is all evidence admissible?

In criminal proceedings, all relevant evidence presented by the parties is prima facie admissible as the UK courts have adopted an inclusionary approach towards evidence in order to favour the victim and ensure a fair trial. In a case in 1861 it was confirmed evidence is admissible even if it were stolen. The rationale for this approach is that the court considers the primary aim of the justice system to be the discovery of the truth and the unearthing of guilt. This is prioritised above the protection of the accused’s right to private life. Nevertheless the courts have discretion under s.78 Police and Criminal Evidence Act 1984 to exclude evidence which lacks relevance and which might, by its admission, endanger trial fairness. This contrasts with the exclusionary approach of the courts of the USA to illegally obtained evidence, which prioritises the need to deter the police from unconstitutional behaviour. Although the UK courts do not wish to encourage illegally methods to obtaining evidence on the part of the police, discovering guilt is prioritised.

Real and confession evidence

Trial fairness may be endangered by the admission of unreliable evidence. English case law distinguishes between illegally obtained real and confessional evidence. Improperly obtained confession evidence, such as confessions obtained under torture contrary to article 3 ECHR, can be seen as inherently unreliable, however real evidence, although improperly obtained, such as evidence obtained through searches or covert listening devices, will remain reliable.

Our laws are mostly based on the English Law.

Jerry Sandusky: You Gullible Malaysians Read This!

Hantu Laut

When Anwar Ibrahim was charged for sodomy many gullible Malaysians refused to believe how it could have happened? How could it be possible for a 67 year old man to overpower and subdue a younger man?

Surbordinate fear of powerful, commanding and dominant superior is real. The thought of losing a job, a partner or husband had made many willing victims of abuse of such monsters.

Sandusky was arrested and charged with 52 counts of sexual abuse of young boys over a 15-year period.

Sandusky is now 68 years old, not forgetting he is also married with children.

Read the chilling story:

I screamed in vain from the basement... but no one heard me': Boy, 18, moves court to tears as he testifies about sex abuse at Sandusky trial

  • Boy, 18said he spent more than 100 nights at Penn State coach's house
  • Investigator testifies that he recommended charges be filed against Sandusky in 1998 after mother of alleged victim came forward
  • Then-district attorney - who vanished in 2005 - disagreed with his findings
  • 'Victim 3' testified that he was fondled twice by Sandusky but hurt as ex-coach never contacted him after he was sent to a group home.

By DAILY MAIL REPORTER

An 18-year-old testified today that he screamed for help while Jerry Sandusky repeatedly raped him and forced him to perform oral sex in the basement of his home.

The prosecution's case in the former Penn State assistant coach's sex abuse trial neared its conclusion after just four days of testimony, with three more accusers taking the witness stand.
The teenage boy, known as Victim 9, told jurors the abuse began with fondling and forced oral sex and led to rape at the house where he spent more than 100 nights. He said the abuse lasted for four years until he was 16.
Terrifying allegations: Jerry Sandusky emerges from a car driven by attorney Joe Amendola for the fourth day of his trial at the Centre County Courthouse in Bellefonte, Pennsylvania

His muffled screams went unanswered by Sandusky's wife, Dottie, who was upstairs. Victim 9 said he figured the basement must have been soundproofed.
'He got real aggressive and just forced me into it,' said the young man, now 18 and a recent high school graduate. 'And I just went with it - there was no fighting against it.'
He said under cross-examination by Sandusky's lawyer Joe Amendola that the attacks sometimes left him bleeding but that he never sought medical attention.
'I just dealt with it,' he said. The courtroom was frequently brought to tears during the young man's testimony.

Victim 9 said he was helpless when Sandusky allegedly came for him, according to ABC.
He said: 'Sometimes (I'd) scream, sometimes tell him to get off me, but other than that, who was there? We were in the basement, no one could hear you down there. We were always down there.'
Victim 9 said he was 11 or 12 when he first met Sandusky in 2004.  The coach took him to Penn State football games and showered him with money and gifts, including a tennis racket and a running suit.
The teen testified that he ended up staying at Sandusky's home more than 100 times up until 2009, maybe even 150 or so, sleeping in the basement which had a water bed.
Accused: Former Penn State coach Sandusky looked a little worse for wear as he left court on the fourth day of his trial after shocking testimony from victims

Sodomy Law:Not Archaic In Some US States

Hantu Laut

After almost a month in Europe it's nice to be back home. The excitement of the Anwar's sodomy verdict has somewhat subsides but a new political inferno is brewing.........Anwar's proposition to abolish what he called archaic laws in response to BBC's interview where he was asked whether he is prepared to change the discriminatory
law against gay rights.

Incidentally, on the morning of Anwar's verdict I was still in Barcelona and the night before wrote my own verdict which I posted at about midnight in Barcelona but due to different time zones just after dawn on the morning of the 9 Jan 2012 in Malaysia.

On the way home I stopped in KL and had dinner with some friends, and as usual typical Malaysian style, you either talk politics or gossip about your friends.Invariably, gossiping about friends was less on my agenda that evening. Our conversations centred between the African waitresses working at the bar we were in then and Anwar's acquittal.I have never seen Africans working in bars or restaurants in KL before, it was the first time, an eye opener, and makes one wonder how did they get work passes for such job? Have our immigration policy changed allowing foreigners from non-traditional territories to work in this country?

Maybe, I should let the Immigration Dept do the worrying and the MACC on its toes.

Back to Anwar's acquittal, I asked one of my friends whether he has read my verdict before the judge officially announce it.His answer was "yes', he has read read it, but suspected someone called me to inform me of the verdict before it went official.....or he thinks, not saying it out loud, I cheated.

Anyway, that was a small part of the story, the bigger problem is how Malaysians are so easily influenced by what they read on the Internet, which, we all know, is completely unregulated and should be taken with a pinch of salt.

As much as there are good things, there are just as much garbage floating in cyberspace. Please read this article from a Malay warrior who has a killer hatred for former Prime Minister Mahathir Mohammad. His personal attack against Mahathir has gone completely berserk and inundated with hate.It makes one wonder who has gone bonkers, he or Mahathir?

You see,how penetrable the conspiracy theory has become, many, my friend included, still think the judiciary is not free, the judges taking orders from politicians.

Anwar and Pakatan's leaders have successfully demonised the judiciary to the throes of hellfire and damnation. The perception of the judiciary of improper conduct will stay for a long time. Here, another writer implied that the judiciary is still ruled by the executive, meaning, the Prime Minister Najib Tun Razak.

Back to Anwar's BBC interview. Anwar's response was somewhat contrivable, giving rise to potentially dangerous ambiguities. There were immediate harsh responses from UMNO and Muslim leaders accusing him of wanting to abolish the sodomy law in this country. All Abrahamic religions are against homosexuality. In the West, as state and religion are separate, religion has no power or jurisdiction over such law.In Muslim countries religion incontrovertibly prevails over such perversion and dispense appropriate punishment.

Anyone, even without reading in between the lines, would have interpreted the archaic law he was referring to was the sodomy law. Certainly, the BBC was not referring to the ISA,OSA or the Police Act when the question was thrown at him.He was asked a specific question and he gave specific answer saying that such archaic law should be reviewed.

Malaysia is not the only country with such law, there are 22 states in the United States that still maintained such laws, though, prosecutions are rare as most acts are consensual and rarely reported. Some states, with strong Christians values even outlawed consensual homosexuality, open and notorious cohabitation and adultery. These are so-called archaic laws but some states still refused to repel the law. Most of these types of law in the US have become purely academic, hardly use and against the US Federal constitution.

In the US, the Federal constitution supersedes state laws.Any consensual sodomy prosecution, by any state, if it goes for appeal to Federal Court, would be overturned by the court.

Let say, if Anwar and Saiful, were to live in Alabama, Arizona or Arkansas and Saiful lodged a sodomy rape report against Anwar, the scenario would be the same, Anwar would be subjected to the law of the state and would be arraiged for trail.

Conspiracy, trump-up, framed or not, there would be a trail, to prove him guilty or innocent, unless the state-attorney found Saiful of questionable character and a liar, like the maid who accused Dominique Strauss-Kahn of rape.

Would Utusan be slapped with the RM50 million libel suit by Anwar?

Anwar's Appeal:The Rule Of Laws or The Rule Of Politics

Hantu Laut

To appeal or not to appeal? The decision lies with the AG, not Saiful, not Saiful's father, not Saiful's friends and ultimately not Najib. The Prime Minister can only listen to advice. The AG can still proceed with or without the PM's agreement.Ultimately, the PM can sought the AG's removal on ground of incompetence.

If the AG determined there was a miscarriage of justice and that the learned judge has erred and Saiful should not be denied justice than an appeal is in the offing.Would that be the case?

However, an appeal, whether based on the rule of law or not would not change the minds of the oppositions, Anwar's supporters and significant part of the population that the judiciary is not independent, that it is the executive that is running the judiciary, no matter how untrue it would be, it would not change the people's perception.

The AG would be seen as the running dog of the government, pliable to the rule of politics.

The biggest loser would be Najib, not the AG and not the warlords in UMNO.

When the boat goes down the captain would be last standing.

Give Anwar A Fair Fight

Hantu Laut

Plato, a philosopher of Ancient Greek epitomised that "if the law is the master of the government and the government is its slave, than the situation is full of promise and men enjoy all the blessings that the gods shower on the state"

Aristotle, another Ancient Greek's philosopher opposed giving the highest official the authority to wield absolute power and advocated that "It is more proper that law should govern than any one of the citizens: upon the same principle, if it is advantangeous to place the supreme power in some particular persons, they should be appointed to be guardians and servants of the laws"

Today, it is called "the rule of law".

Politicans who have been allowed to become too powerful have shown little or no respect for the rule of law. Those that had become cult figures ended up as tyrants and mass murderers. From Stalin to Hitler and nearer home in Asia, Pol Pot of Cambodia, the modern world have seen a fair share of genocidal tyrants ruling by their own decree rather than the rule of laws.

The "Arab Spring" which swept through the Middle Eastern Arab countries were consequences of the abrogation of fundamental human rights and the rule of law, which, in this modern civilisation, should even override divine law.

Many political pundits made wrong predictions of the outcome of Anwar Ibrahim's sodomy trail, most say he would be convicted with long period of incarceration and some suggesting there would be an appeal by the prosecution in the event he was found not guilty, which I do not doubt if the Prime Minister lends his ears to the wrong people.

Anwar had been given due process of the law, an appeal would again ignite sympathy for him and makes Najib seemingly afraid of a fair contest. Taking Anwar on a level playing field, is the thing that Najib should do, it would give him due respect.

A free Anwar is of less political threat to the BN than Anwar in the prison, or hanging the sword of Damocles over his head. The old UMNO ways of politics of intimidation and war mongering do not sell anymore. It's time these antiquated politicians wake up and make an exit and let more progressive and younger men take over.

It was Mahathir and UMNO that made Anwar a national hero, otherwise, he would have joined the likes of Musa Hitam and Tengku Razaleigh, waiting in political purgatory, not knowing when the doors to heaven would open.

Musa Hitam had given up hoping completely, Razaleigh, still aspires the highest office, but with Anwar a free man, the chance of him becoming PM has sunk to ground zero. The opposition do not need a replacement prime minister simply because they would not be anywhere near Putrajaya. After the blistering attack at his own party they would not be needing him anymore. This good man is only good for Gua Musang. He has not been able to capture Kelantan for the party for the past two decades.

Najib has a good chance of winning the 13th GE.He should not be afraid to weed out the warlords in his party and those who insist to continue riding the gravy train. These are the losers who are going to drag him down if he does not act now.

As for Anwar, the AG should not appeal, just leave him to the elements and a fair fight against Najib.

Why I Predicted Anwar's Acquittal - No Elections ?

Hantu Laut

Did Najib deliver the master stroke? Has he had a hand in the court decision to acquit Anwar?

I would say NO!

Anwar and Pakatan's leaders still upheld the notion that the judiciary is not independent.

If a layman like me can predict the verdict of the court correctly, it is most unfair and scurrilous to speculate that the court is still not free of executive intervention.

The judge has made his decision based on physical and circumstantial evidences presented to the court, some of which appeared to be spurious claims.

It was not a case of the court not being independent, it was a case of the prosecution's incompetence of pursuing a case which the AG should have rightfully thrown in the rubbish bin.The AG should seriously reconsider his role as a public prosecutor.

I have been following the court case quiet closely and see how the prosecution bungled the case big time.DNA evidence presented to the court seemed to have been plucked out of thin air.One may ask the irony of the victim's confession of not washing his arse for a few days to preserve DNA evidence.

In most rape cases there were always a heightened desire to cleanse oneself quickly of the stigma of rape.A rape victim always suffer the anguish of feeling dirty but in the case of Mohd Saiful he joyfully did not shower or washed himself and did not seem to have suffered the trauma of a rape victim. The first medical examination of his arse showed no evidence of penetration of any kind.

The acquittal of Anwar will not enhance Pakatan's chance of winning the 13th General Elections and there won't be any elections in February or March.

It would be fatal and foolish for Najib to hold the elections soon after the verdict. He still has over a year before he is compelled to dissolve parliament.

The reason of the declining economy as to why he should call elections soon is fallacious. The economy will not suffer a meltdown, far from it, if there'll be one, it would be a manageable short economic doldrums.

Time is on his side.

The Verdict: Guilty or Not Guilty?

Hantu Laut

The verdict! Will Anwar be found guilty or not? Will the verdict change the political landscape of this country?

PKR drumming up supports for massive street rally hoping to turn it into Malaysian version of the Arab Spring, may, turn out to be a bridge too far.

As much as I am not fond of Anwar, I think he should get off the charge against him.

The prosecution screw up pretty well.

In not so many words, Anwar, should be as free as a bird.

The world is watching.

I Am Afraid Of Anwar Ibrahim!

Hantu Laut

Effective leadership is not about making speeches or being liked; leadership is defined by results not attributes....Peter Drucker ....and I agree with him.

Hypocrisy, equivocating, pretension to infallibility and lies are not attributes we want of a person to be our leader.

"I am not afraid of Anwar Ibrahim" Najib said at the closing of Selangor BN convention.I am afraid the Prime Minister is wrong, Anwar is cleverer, cunning and more ruthless than he would like to think.

I am very very afraid of Anwar Ibrahim.I am afraid of the nation's future.I am afraid that Malaysians may be making the biggest mistake if they chose Anwar to lead this country.I don't mind if Nik Aziz,Mat Sabu or even Tungku Aziz of DAP to be PM as long as it is not Anwar.

This is not about playing politics or hate, it's my true feeling, that Anwar is not suitable material for premiership.I have said the same when he was in UMNO when he delivered his speeches in his bombastic language to impress the lesser beings. He soon realised not many men in the street understand his lofty speeches and grandstanding.

No man can live by his folly, the evilness of men will not pass the test of time.Redemption, sometimes, may come with a deadly blow and it will. The notion that the camera never lies is a fallacy.Anwar's day of reckoning will come when the people woke up to find wools over their eyes of his theatrical acts.

How can you trust a man who protested and called for free and fair elections for the nation but his own party elections are so heavily tainted with trickery, corruptions and underhand tactics.

Past lies, include promise of taking over the Federal government on 16 Sept 2008 in a political coup that had the whole nation riveted in anticipation, now as famous as the infamous 9/11, accused the government of a plot to assassinate him that led him to take refuge in the Turkish Embassy, second attempt by the government, complicit with Perkasa, to murder him by sabotaging the brakes on his car, third attempt by the government of trying to murder him during the 9 Sept BERSIH protest march for free and fair elections and of course as we all know the world famous sodomy trail plotted by Najib and Rosmah.

If that's not enough trouble for him, there were also death threats on her daughter Nurul Izzah and threat to kidnap his grandaughter.

Whatever it is, if the Malaysian government was really involved in trying to murder him, I am sorry to say they are completely inept and a bloody disgrace......pathetic amateur.

The protagonist claimed he is innocent and the victim of government's conspiracy.

I have no wish for Anwar to go to prison for the sodomy charge and I think he should not, his political demise should be left to the people.

Malaysians are so blinkered by the specious rhetoric and pretentious infallibility of the man, so much so, they can't see the trickery and deception behind the mind-bending charades.

How long does DNA last?

The Guardian

Human DNA has been recovered from a Neanderthal fossil 70,000 years old. That's a record, but there may be plenty of DNA recoverable from a human body 10, 50 or even 150 years after death.

The bodies of the Romanov royal family, executed during the Russian revolution, were identified from DNA comparison in the last decade. US scientists recently confirmed the death of the outlaw Jesse James after they exhumed a disputed corpse. Time, says Mark Thomas, a forensic anthropologist at University College London, is not really the problem, even in the tragic circumstances of the Indian Ocean tsunami.

The technique of DNA sampling is less than 20 years old, but has become standard practice the world over. Standards, however, are not quite the same the world over, which may be why a Japanese forensic delegation has announced that it will re-examine all the bodies originally handled by Thai experts, why China has offered to collate the data, why a US team has announced that it will handle the samples from all "foreign-looking" victims, and why the Israeli government sent a 19-member team to help search for Israeli victims.

Both volunteers and resident experts have a host of challenges - stricken relatives, rapidly decaying bodies and damaged infrastructure for a start - but at least time is on their side. DNA is vulnerable. It breaks down in sunlight and water, and there are enzymes that naturally destroy it. But long after death, samples would survive in teeth and bones. Police forensic scientists - often working with only the tiniest samples from a fingerprint or a spatter of saliva - have to worry about the possibility of contamination. But the teams of forensic experts working in Thailand to identify the thousands of victims have no such worries.Read more.

What Happened In 1998 ?

Hantu Laut

Ahmad Ismail was a staunch supporter of Anwar Ibrahim during the initial period of Anwar's sodomy allegation and the sacking from his deputy premiership and from the party.

His defiance against the sacking of Anwar was much reported in various newspapers at that time.

Below are some of them:

1.The Umno Bukit Bendera division, which held a special meeting yesterday, decided to ask that Anwar be given a fair trial in defending himself against the allegations.
"As stated by Dr Mahathir before, we should not pronounce someone guilty until the courts have stated so.
"Anwar should be given a chance to explain his side to the people so that peace can be preserved in the country," the division said in a Press statement today.
The statement was signed by Bukit Bendera division chief Senator Datuk Ahmad Ismail, his deputy Azmi @ Iskandar S.H.O. Merican, its Youth wing leader Mohd Ismail Mohd Othman, deputy Youth chief Ismadi Abu Bakar, assistant secretary Syed Abdul Kadir Aidid, deputy Youth treasurer Azhar Ahmad and the division's Youth information chief Yahaya Ibrahim.
Other signatories were Bukit Bendera Wanita chief Haslinda Mohd Hashim and her deputy Asnah Hussain.
The division said it supported Dr Mahathir as Umno president and Prime Minister.
"We also support Anwar as both are personalities and leaders who are hard to replace," they added (New Strait Times 9 Sept 1998)

2.The state Umno's recent meeting which endorsed the supreme council's decision to expel former deputy party president Datuk Seri Anwar Ibrahim was held in proper manner.
Its deputy liaison committee chairman Datuk Mohd Shariff Omar, in saying this, dismissed Bukit Bendera division chief Datuk Ahmad Ismail's claims that the meeting was not properly held and therefore the decision taken by the nine division leaders present was null and void.(The Sun 14 Sept 1998)

3.The crowd of supporters at sacked deputy prime minister Datuk Seri Anwar Ibrahim's residence came alive tonight when his wife, Datin Seri Dr Wan Azizah Ismail, took centre-stage to thank them for their support.
Another speaker was Senator Datuk Ahmad Ismail of Umno Bukit Bendera who said the division fully supports Anwar. Anwar, who addressed the crowd about 10pm, said he was touched by their support (The Sun 15 Sept 1998).

4.Datuk Ahmad Saad, Datuk Ahmad Ismail and other Penang politicians closely allied with Anwar attended a dinner at Datuk Abdullah's house on Saturday night.
Datuk Ahmad Saad, the acting divisional chief in Anwar's former constituency, said that the former No 2 should have refrained from attacking the party, and put his own interests on the backburner.
"When Pak Lah was dropped from the Cabinet in the 80s, he did not attack the government or anybody. He just kept quiet," he said, referring to the current Deputy Premier. (Straits Times 21 June 1999)

Is Ahmad Ismail a stooge or playing the racialist game just to get more supports from the Malays at the expense of UMNO

It's Consenting Adults Now ?

Hantu Laut

From being forced (rape) to engage in sodomy,it has now become consensual sex, which means sex between consenting adults. One is charged and the other one is not, so our learned minister says Saiful can't be charged because he is the complainant, but the law says sodomy is a serious criminal offence, irrespective of whosoever engaged in it.

Assuming I had a fight with my friend and I was the aggressor and bashed him up but was the first one to lodge a police report, so I am the complainant, I shouldn't be charged.

What kind of justice system we have in this country.Charge the victim not the perpetrator. Below is part of my blog post on 25th July.

"No matter how much I wanted to believe that Anwar might be guilty of the allegation, it is even harder to believe that Anwar can force himself on a young man of Saiful age six times before he felt utterly disgusted and ran to lodge a report first with the DPM and than to the police. If it was against your will, wouldn't you run away and lodge a police report the first time it happened or was it consensual and something had gone terribly wrong?"

I would still give Anwar the benefit of the doubt. Now we can rule out rape of Saiful. He has unashamedly admitted to consensual sex with Anwar. It would be interesting to know why he changed his mind after the sixth time.

I believe many of you would still remember the arrest of John DeLorean back in 1982 on charges of drug traffiking. The court throw out the case when the judge found out he was set up by the FBI, an entrapment, which is illegal in the U.S.That speaks volume of law enforcement agency and their capacity in resorting to dirty tactics.

De Lorean is the founder of the DeLorean Motor Compnay which ran into financial trouble and was accused of drug traffiking to raise money to save the company. The company went bankrupt in 1982 and closed down for good.

Let's hope justice prevails in this country.

P.I disappeared, doctor disappeared,a blogger charged for sedition, another blogger arrested and an ex DPM charged for sodomy.

It looks like the government have shot itself in the foot.

Is Anwar Victim Of Dirty Politics ?

Hantu Laut

This must be the umpteenth time I have said I am not a fan or supporter of Anwar Ibrahim but I must confess I could end up being his sympathiser.

I have never liked Anwar's style of politics even from his days in UMNO.He is no doubt a shrewd politician but also quite adapt to dirty politics.

He successfully knocked down the late Ghaffar Baba and took over the deputy president post of UMNO and became the deputy prime minister. After having messed up Ghaffar, who was not half the political animal that he was, he coveted the most powerful position, held by the very man who nurtured him to be his successor. From protege to conspirator his meteoric rise in the party hierarchy has not been without the help of former Prime Minister Tun Mahathir Mohammad, the man whom he wanted to overthrow but failed and for which he had to pay a heavy price.

He was released from prison before serving his full sentence when Abdullah came to power.

His impatience and hunger for the top job has re-emerged after the March 8 General Elections. The substantial gain by the oppositions led by him has boosted his ego to grab the trophy by hook or by crook. He claimed to have 30 MPs from the other side ready to jump over to his side to form the new government by 15th September. He even labelled himself "Prime Minister in waiting".

Anwar is a man for himself, he has no gratitude and empathy for others and those who had helped him.He thinks highly of himself and exploited those around him.His charisma and double-speak draws people to him. With Anwar it is "familiarity breeds contempt" the closer you get to him the better you get to know of his character. From a distance he is the knight in shining armour.

However, Anwar dirty politics are pale compared to what he is getting in return if his claim of trumped-up charges against him were true. Fresh sodomy charge has been brought against him and is likely to kill his chance of going for the trophy.

Few politicians have been completely free of dirty politics. The use of slander, libel, forgery and other criminal acts to embarrass a political rival have long been recorded in the history book of politics.

While the ordinary people may be offended by the use of dirty politics, politician are notoriously immune to such allegations, such as the case of Deputy Prime Minister Najib Tun Razak who claimed to have been slandered by numerous individuals. One particularly damaging piece, not only to his reputation but that of his wife, was Raja Petra Kamaruddin's Satutory Declaration. Surprisingly he and his wife had not taken any civil action against Raja Petra, who deservedly should be dragged to court or taken to the cleaners for the slander, if it can be proven to be slander and not the truth. The government had instead charged him under criminal law which is probably less messy as compared to a libel case which can be a long drawn and embarrassing affair.

Most examples of dirty politics are apocryphal. The recent mud-racking campaign on the internet about Barack Obama being a Muslim was one such example. It was polled that 1 in 10 Americans believe the story.Even the highly esteemed New York Times ran a caricature of him and his wife in Islamic attire, which it claimed was only a political satire.A political satire with an agenda and done in bad taste to embarrass him and create doubts in the minds of the American people about his integrity.

In any political campaign, candidates have two fairly simple tasks, one to promote himself and the other to knock down his opponent. The knocking down of opponent needs dirty job and dirty jobs needs dirty people.

U.S President Richard Nixon was reputed to have maintained an entire staff of experts in dirty politics. The President's enemies were routinely investigated for their personal life and that of their family, audit of their income tax with IRS and anything that can smear their reputation. His dirty politics ended with his prosecutions for the Watergate affairs.

Is Anwar the victim of dirty politics ? The question is why again ? Is there something more sinister about him that we the layman have no knowledge of ?

Anwar maintains that he had been victim of trumped-up charges in the first sodomy case. When Abdullah became PM the court reversed its previous decision and exonerated him of the said crime.

The recent accusation by his aide of being sodomised by him again got him screaming a frame-up, accusing the government of trying to fix him and destroying his chance of taking-over the government. The accuser had been seen visiting theDPM's (Deputy Prime Minister) house before he lodged a police report. The DPM who initially denied of knowing the boy later admitted to have actually met him in his house to console him over his predicament.

The government is walking the tightrope as the whole world is watching its case against Anwar.

Even if he is charged he should not be deprived of his democratic rights to contest the by-election. He is innocent until proven guilty.

Now, can the general public be blamed for buying Anwar's story even if there was no conspiracy.

The outcome will be translated at Permatang Pauh.

Will The Government Be The Toyol(Leprechaun) Again?

Hantu Laut

It was reported in Malaysia Insider that the government may appoint the Solicitor-General (SG) as DPP (Deputy Public Prosecutor) in the Anwar's sodomy case, if he is charged.

In my earlier article I have recommended another person to be the prosecutor instead of the AG (Attorney-General) due to serious allegations by Anwar of past misdeeds in his previous sodomy case.

I can see the PM is taking a step in the right direction and I do believe the SG Datuk Idris bin Harun is competent to do his job without fear or favour. Will public opinion change?

Although the government can ignore public opinion and do what any government should do under normal circumstances, but in this particularly dicey case, the government should walk with caution and should be seen as having no vested interest in the case. The services of an independent reputable foreign prosecutor should be seriously considered to complement the SG.This will remove all doubts from majority of the population that the government is still pulling  the strings.

Below are background information of the Solicitor-General:

Duties and Function of
Solicitor General

The Solicitor General assists the Attorney General and is by law empowered to perform any of the functions that can be performed by the Attorney General. This is provided under Section 40A of the Eleventh Schedule to the Federal Constitution.

Under subsection 376(2) of the Criminal Procedure Code, the Solicitor General shall have all powers of a Deputy Public Prosecutor and shall act as a Public Prosecutor in the absence or inability of the Attorney General to act.

The Solicitor General is also responsible for civil matters, interviews, intakes, transfers, postings and promotions of officers and any other duties directed by the Attorney General.

Duties and Function of
Solicitor General II

The post of Solicitor General II has been created and came into effect on 16 April 2007 through the Waran Perjawatan Bil. A46 Tahun 2007 dated 20 April 2007. Following the existence of the new post, currently there are two (2) Solicitor Generals in the Attorney General’s Chambers.

The Solicitor General II is responsible for matters related to drafting of legislations, law reform and revision matters, responsible in overseeing and supervising the State Legal Officers and all administration matters other than finance and budget, interviews, intakes, transfers, postings and promotions of officers and any other duties directed by the Attorney General.

Below is the Organisation Chart.

From the chart above it appears that the Solicitor-General is under the Attorney-General.

As I have said earlier the SG may be impartial and competent but public opinion will not change if he alone does the job.

Many Malaysians believe in the occult, toyol and cerita dongeng but the conspiracy to fix Anwar is no cerita dongeng. To them it is true and the toyol is the government.

It's time the Prime Minister and his government walk the ground and feel the pulse of discontent and do something about it.

It's public opinion that makes or kills a government and Anwar knew it and depended on it to discredit the government.

Who is the wolf in sheep's clothing ?

Justice Must Be Seen To Be Done

Hantu Laut

Anwar Ibrahim might not be my favourite politician but I hope the rule of law will prevail in this country if the police decides to charge him.

The government  with its credibility at stake must go out of its way to ensure a fair trail for Anwar Ibrahim.None of those currently accused by him of past wrongdoings should be allowed to be involved in the case, particularly the IGP and the AG, whom he has accused of fabricating evidence in his previous sodomy case.So far the Prime Minister has kept his promise by not allowing the two to be involved.

It is also imperative that the Court and judges should have no fear to call upon any prominent figures as witnesses if the need arises. No immunity should be given to any of those holding high offices, including the PM and DPM, from appearing in court should their presence be required as witnesses.

If the government is really serious about salvaging its shrunken popularity and its inglorious reputation than it should consider taking a bold step to do what has not been done before.

Since all branches of government including the judiciary are under trail in the court of public opinion and to appease the sceptics of the impartiality of the government in the case, serious consideration should be given to appoint independent public prosecutors (foreign or local) and a trial by jury or if that is not possible than  additional judges chosen from Britain or any of the Commonwealth countries to sit with our judges to hear the case.

I hope Pak Lah will have the conscience to do what is right.

The Redemption Of Anwar Ibrahim ?

Hantu Laut

Why is the government dragging its feet on the investigation regarding Anwar's sodomy case. The recent disclosure by our iconoclastic Raja Petra of a medical report, not that I believe the report is conclusive, that confirmed the absent of any sign of buggery of the complainant Saiful has added more fuel to an already burning fire. The government should either release the result of the investigation without further ado or close the case if there were insufficient evidence to charge Anwar.

Prime Minister Abdullah Ahmad Badawi must understand that public opinion is against his government and the longer the delay the more severe is the people perception of the government intention of trumped-up charges against Anwar. He will gain more ground with his sympathisers and supporters and is deemed innocent even if proven guilty.Even those sitting on the fringe are beginning to doubt the government sincerity in the case.

To make matters worse the emergence of an Uncle Pet, an uncle of Saiful, whose real identity is still not known and with an image that is not exactly an epitome of wisdom, although he might be completely innocent, is not adding any credibility to the story.

Why did the doctor at the private clinic released Saiful medical report to be made known to the public? He is an Anwar's sympathiser or a conscientious medical practitioner? How thorough was his examination of the patient? What kind of doctor is he that breached professional ethic? If he thinks his finding is correct and as a professional why not stands by his reports?

Below are some of the reactions of Anwar's supporters and sympathisers taken from various blogs:

SOME CONTENT IS OBJECTIONABLE. READERS DISCRETION IS ADVISED.

1.Raja Petra, I SALUTE U !!!!

Pandan muka Saiful & family. Becareful, if I ever meet him I will shaff a durian up his ASS! Never know how LOW can a person go to prostitute himself in the name of $$$$$!!!

2.AG first fellow who should kena `taro`. He ordered the wrongful arrest. That also abuse of power.AG must be suspended immediately and placed under house arrest.

5.I think the whole pack of government lackeys are clowns. It is like a circus show showing the government fooling Malaysians to believe the sodomy case of Anwar. Now,the cat is out of the bag and Malaysians can throw shit at the Home Minister who is a disgrace in trying to spread lies with facts to foreign dignitaries recently. What a nincompoop Minister he is and I hope he sinks his face in the mud to escape embarrassment from them later.

6.Saifool has now become a pain in BeeEnd's Arse.Sakit!!!

7.RPK ain't a doctor, but in this case, RPK aint the only one spinning out of control.First it was a meliwat thingy. Then they checked DSAI's private part.Followed by the allegation that it ain't a dick to anus thing, but a plastic insertion matter. Then the doctor disappeared, just like that Private Eye.C'mon, folks, what else the authority has to spin?

8First it was a meliwat case. Then DSAI got his dick checked.Followed by the "plastic insertion" thing. What's next?Broom stick??Aiyoh !! Please lah !! Enuf already lah !!!

Those comments are not from Malaysia Today but taken from other top blogs in the country.
